As defamation lawyers we are often involved in analyzing a potentially defamatory post. In today's world, it is getting harder and harder to figure out whether some blog comment or post is a statement of fact. Statements of fact can now be couched in statements of opinion and craftfully presented so that Google picks up the factual words and presents those it is results. It's a game that brings into play issues unique to the law of the Internet and issues your typical defamation lawyer will have a hard time grasping. At Dozier Internet Law, our defamation lawyers deal with this type of analysis often. Here is the issue I recently presented to the California Society of Plastic Surgeons at their annual conference in Lake Tahoe.

I was involved with starting a forum site. One of our council member logged on with a fake name and berated and accused my family by name of all kinds of things by asking questions to start doubt in the other town peoples minds. The site is still up and has had over 2000 hits, there are only 400 people in our town. He has since come out and made himself known. (he was cought) He refuses to retract any statements he has made. He is only 22. Can I sue him?

How difficult is it to stablish a web site that can be used to clear a person's name once he/she have been victimized by a defamation of character attack? Naturally, such a site would have to have the help of law enforcement agencies.
